Terms of Service

By installing ReviewPilot from the Shopify App Store or by accessing any Purvell service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not install or use our services.

These Terms form a binding agreement between you (“Merchant” or “you”) and Purvell (“we”, “us”, “our”).

ReviewPilot is a Shopify application that automates the sending of review request emails to your customers following order fulfillment. The service includes:

• Automated detection of fulfilled orders via Shopify webhooks.
• AI-generated, personalised review request emails sent on a configurable delay.
• A Shopify admin dashboard for managing settings and viewing request history.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.

You must have a valid Shopify store and comply with Shopify's own terms of service to use ReviewPilot. You are responsible for maintaining the security of your Shopify account. Purvell is not responsible for any loss arising from unauthorised access to your account.

You agree not to use ReviewPilot to:

• Send emails to customers who have opted out of marketing communications or who have not made a purchase from your store.
• Send spam, harassing, illegal, or misleading communications.
• Circumvent or manipulate Shopify's review systems in violation of Shopify's policies.
• Attempt to reverse-engineer, copy, or resell any part of the ReviewPilot service.
• Use the service in any way that violates applicable law, including CAN-SPAM, CASL, GDPR, or equivalent regulations governing commercial email.

You are responsible for ensuring your use of ReviewPilot complies with all applicable laws governing email marketing in your jurisdiction and the jurisdictions of your customers. This includes, without limitation:

• Providing a lawful basis for sending review request emails to your customers.
• Including a valid unsubscribe mechanism if required by applicable law.
• Complying with your store's own privacy policy.

Purvell provides a tool; you are responsible for how you deploy it.

Purvell and ReviewPilot, including all associated software, trademarks, and content, are the property of Purvell. These Terms do not transfer any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable licence to use ReviewPilot solely for your own business purposes during the term of these Terms.

Current pricing is displayed within the ReviewPilot listing on the Shopify App Store and within the app dashboard. All billing is handled by Shopify's billing system. By approving a charge on Shopify, you agree to Shopify's billing terms in addition to ours.

We offer a free plan. Paid plans provide additional features as described in the app listing. We reserve the right to change pricing with 30 days' notice to active paying subscribers.

You may cancel ReviewPilot at any time by uninstalling it from your Shopify store. Uninstalling cancels any active subscription immediately. We do not offer prorated refunds for mid-cycle cancellations, except where required by law.

ReviewPilot is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that emails sent via the service will result in reviews. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, Purvell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of ReviewPilot, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to Purvell in the three months immediately preceding the claim.

You agree to indemnify and hold harmless Purvell from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of ReviewPilot; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content or communications sent through the service on your behalf.

ReviewPilot integrates with third-party services including Shopify, Google Gemini, and Resend. Your use of those services is governed by their respective terms. Purvell is not responsible for the acts or omissions of any third-party service.

We may revise these Terms at any time. Material changes will be communicated by updating the “Last updated” date above. Your continued use of ReviewPilot after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation in the first instance. If negotiation fails, disputes shall be submitted to the courts of competent jurisdiction.
